DMCA Notice & Takedown Policy

PlaceChat respects the intellectual property rights of others and expects users to do the same. This page explains how to submit a Digital Millennium Copyright Act (“DMCA”) notice or counter-notice.

1. Scope

This DMCA Notice & Takedown Policy applies to user-generated content posted on PlaceChat, including messages, usernames, and any other material uploaded or shared through the Service.

If you believe that content on PlaceChat infringes your copyright, you may submit a DMCA notice requesting that the content be removed or access to it disabled.

2. Submitting a DMCA Notice

To file a DMCA takedown notice, please send a written communication that includes all of the following:

  • Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
  • Identification of the allegedly infringing material that is to be removed or disabled, including enough information to allow us to locate the material on PlaceChat (for example, relevant channel name, place/location, approximate date and time, and any available message identifiers or screenshots).
  • Your contact information, including your full name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
  • Your physical or electronic signature (typing your full name at the end of the notice is sufficient for electronic submissions).

3. What Happens After We Receive a Notice

Upon receipt of a valid DMCA notice, we may:

  • Remove or disable access to the allegedly infringing content.
  • Notify the user who posted the content that it has been removed or restricted.
  • In appropriate circumstances, suspend or terminate accounts of repeat infringers.

We may also request additional information from you if we are unable to determine whether the content is infringing or to locate the material based on your notice.

4. Submitting a Counter-Notice

If your content has been removed or disabled as a result of a DMCA notice and you believe the removal was a mistake or that you have the right to use the content, you may file a counter-notice.

To submit a DMCA counter-notice, please send a written communication that includes:

  • Identification of the content that was removed or disabled and the location where it previously appeared (if known).
  • Your full name, mailing address, telephone number, and email address.
  • A statement under penalty of perjury that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if you are outside the United States, for any judicial district in which PlaceChat may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.
  • Your physical or electronic signature (typing your full name at the end of the notice is sufficient for electronic submissions).

Counter-notices should be sent to:

If we receive a valid counter-notice, we may restore the content unless the original complainant notifies us within a reasonable period that they have filed a court action seeking to restrain you from engaging in the allegedly infringing activity.

5. Misrepresentations

Under the DMCA, anyone who knowingly misrepresents that content is infringing, or that content was removed by mistake, may be liable for damages (including costs and attorneys’ fees). Please be sure that you have a good-faith basis for your claim before submitting a notice or counter-notice.

6. Repeat Infringers

It is PlaceChat’s policy, in appropriate circumstances and at our discretion, to disable or terminate accounts of users who are determined to be repeat infringers.

7. Changes to This Policy

We may update this DMCA Notice & Takedown Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of PlaceChat following any changes constitutes your acceptance of the updated policy.
